Welcome to Instinctive Studio (“Company,” “we,” “our,” or “us”). These Terms & Conditions (“Terms”) govern your access to and use of our website https://www.instinctive.studio/ and the creative services we provide (“Services”). By accessing our website or engaging our Services, you agree to comply with and be bound by these Terms.
1. Eligibility
You must be at least 18 years old and capable of entering into a legally binding contract to engage with our Services.
2. Services
Instinctive Studio provides creative strategy, design, and related professional services. The scope, timelines, and deliverables for each project will be agreed upon separately in writing (via email, proposal, or contract). We may update or modify our Services at our discretion.
3. Payments
- Payments for our Services are processed securely through third-party payment gateways, including Razorpay.
- By making a payment, you also agree to the Terms of Use and Privacy Policy of Razorpay.
- We are not responsible for delays, errors, or failed transactions caused by third-party providers.
4. Fees, Invoices & Refunds
- Fees for our Services will be clearly communicated before commencement of work.
- All applicable taxes will be added as per law.
- Payments must be made in accordance with the agreed invoice schedule.
- Refund Policy: Since our work is customized and service-based, payments once made are generally non-refundable. Refunds may be considered only in exceptional cases and at our sole discretion.
- Any disputes regarding billing should be raised with us at admin@instinctive.studio within 7 days of invoice/payment.
5. Intellectual Property
- All creative concepts, designs, and materials produced by Instinctive Studio remain our intellectual property until full payment has been received.
- Upon full payment, ownership of the final deliverables (as defined in the project scope) is transferred to the client.
- We may retain the right to showcase completed work in our portfolio and marketing materials, unless otherwise agreed in writing.
6. Confidentiality
We respect the confidentiality of client information and agree not to disclose project details to third parties without consent, except as required by law.
7. Limitation of Liability
While we strive to deliver Services to the highest professional standards, Instinctive Studio shall not be liable for indirect, incidental, or consequential damages arising from the use of our Services. Our liability, in any case, shall not exceed the amount paid by the client for the specific project in question.
8. Termination
Either party may terminate a project by giving written notice. In such cases, the client will be billed for all work completed up to the date of termination.
9. Governing Law
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka.
